Jon,

I am sorry for the delay in responding to your inquiry about the forced placed insurance. A refund of 940.17 was applied to your client's account on March 08, 2011. I did not see that, my apologies. An escrow analysis has not yet been performed on your client's account because the loan needs to be brought current before we do. Once the loan is brought current I will have their account analysis and have the escrow balance spread over 60 months.

Ms. Humperdink,

The Settlement Agreement regarding this matter is attached. It was updated to include amounts for the forced flood insurance, another payment and specification of the NBI account # and fannie mae loan #. This is at leaset my fourth transmission of the document without a substantive response.

At this point since the amount owed does not appear to be a significant issue. It seems to be $7,222.88, ($6,606.62 due through June 1, 2011 plus $616.27 through 7/1/11) plus once the impound calculation is done an amount not to exceed an additional $7 per month for the a amortized pro rata portion of the Rump Rider forced flood insurance.

Over the last 3-4 months I have received no objection to any specific substantive language in the agreement. It was revised to include FannieMae at DMI's request and if FannieMae objects they can be removed. Again my client's are flexible and will accommodate any reasonable objections.

Shall we resolve this issue in a timely manner per the Fannie Mae Code of Conduct? If not please explain the reasons for the delay.

Ms. Humperdink,

Could you clarify what you mean by the "escrow shortage" regarding the county taxes. Property Tax disbursement are, by definition, included in the Principal Interest Taxes and Insurance (PITI) payment reflected in your quote calculation dated 5/6/11. If you are saying that the "escrow shortage" of $1,993.24 is due in addition to the $7,222.88 to bring the note secured by the deed of trust current, please explain. The principal and interest portion of the payment is 366.61 plus an escrow impound for taxes and insurance of 249.66 totalling 616.27. If the Innocentss are making about 12 payments the Escrow portion of the payment
will total approximately $3,000 about $1,000 more than the "escrow shortage" so they should, at the end of the process, have about a $1,000 surplus in their escrow account.

The amount for the Forced flood insurance was included in the settlement amount because it was an extraordinary event.

Also your taxes add up to $1,557.28, the forced flood pro rata amount was $384.83, that leaves $51.13 unaccounted, relative to the "Escrow Shortage" of $1,993.24, is that for payments to property/flood insurers?

Ms. Humperdink, if the "Supervisors" at DMI were as assiduous as you and would respond to the substance of the proposed settlement agreement, we could have resolved this matter in February.
