We were now coming to the end of a particularly shitty year, another month had passed and the blame game was in full force between NBI and Fannie Mae. SWMBO was ready to bury me in the back yard, and Lawyer man was doing his best to keep me from throwing in the towel and walking away. I'd already decided that Overlord and Asshat could have the house. I was ready to move on. Bring on the foreclosure, fuckers. On December 21, just a few days before Christmas, Lawyer man sent me another letter:

Mr. Innocent, 
I spoke to Areola Humperdink at New Bastards Inc. again today. She claimed that she transmitted all the information to Fannie Mae and is still awaiting direction. But she won't tell me who she spoke to or the Fannie Mae office responsible so I can confirm her communications. This is follow up sent to Fannie Mae, because they never acknowledged the complaint I sent one month ago.

Dear Mr. Overlord:

Fannie Mae has neglected to respond to a letter that my firm sent it a month ago (November 24, 2010) regarding your customers the Innocents. Fannie Mae holds the mortgage on their home. They have lived under the cloud of imminent foreclosure since your Loan Servicing Agent, New Bastards Inc. (NBI) sent them a Notice of Default on their note, on July 13, 2010. The last time I wrote, the stress of an impending foreclosure weighed heavily on the Innocents as Thanksgiving approached. They now face a bleak and uncertain Christmas.

My prior letter, in detail, outlined how your agent/loan servicer, NBI, had failed to meet your ethical code by promptly and straightforwardly resolving the issue.

In summary, NBI sent the Innocents a grossly inaccurate Notice of Default. The Innocents responded with proof of payment, and NBI has failed to credit the Innocents with payments evidenced by cancelled checks, all promptly provided to NBI.

NBI began blaming Fannie Mae for its failure to resolve the issues in November. NBI initially claimed no Fannie Mae representative with authority would respond to its communications. NBI now claims that the proof of payment has been transmitted to Fannie Mae but, no one with authority at Fannie Mae has responded. NBI declined to identify the responsible Fannie Mae Office much less the responsible employee.

Fannie Mae has violated its Ethical Code of Conduct. That Code requires it to treat . . . (C)ustomers fairly, honestly, and in a straightforward manner. . . (E)ngage in transparent and open communication inside and outside the company . . . (And) take responsibility, apologize for (its) mistakes, own the problem, and resolve issues in a timely manner.

Mr. Overlord because of your Code I wrote to you personally trusting it meant something and that Fannie Mae would conform to it. NBI needs only do arithmetic to compile a correct accounting. NBI has failed to send an accurate accounting since it declared the default in July.

Conclusion

You are responsible for the acts of Agents like NBI. The Innocents again request that Fannie Mae accept responsibility for NBI’s mistakes and that Fannie Mae apologize, own the problem, and resolve the issues in a timely manner.

For more than a month, NBI has blamed its refusal to act on Fannie Mae, claiming Fannie Mae is ignoring NBI’s effort to resolve the issue. Since your code of conduct calls for transparency and timely response, please state whether NBI’s claim is true.

Despite the anxiety caused by NBI’s five months of foreclosure threats, the Innocents remain open to discussing this matter. They want to remain in their home. They have opened a segregated account for the undisputed payments and will pay the amount justly due.
