a sunshine day?

The bastards and their agreement ultimatum hit me the wrong way, and my first reaction was to take my savings and run. "Fuck all y'all!"  SWMBO was on board. Eight thousand dollars would put a new roof on my other house, allow for some minor remodeling, a down payment on a much-needed new vehicle, and possibly the penis reduction surgery I've been coveting. I keed...about the surgery. No comments, please.

The downside, of course, would be the foreclosure on my credit. As the day of reckoning approached, we still hadn't made up our minds. The thought of living mortgage free was extremely inviting, but the other home is half the size, and I wasn't sure if  I was ready to part with half of my belongings to facilitate the move. Plus, I didn't want to move in the hottest part of the year: I've done that in the past, swearing never to do it again.

We vacillated, deciding at the last minute to send the bastards the money, because of (1) the snide comment/dare made by Fannie Mae about my ability to bring things current, assuming we had not been saving the mortgage payments in a segregated account as claimed, and (2) we had endured a debilitating battle for over a year, and needed time to relax and heal. We may decide in the future to move, but it would be on our terms, not because of a foreclosure.

Jon informed us that we could sue, but it would cost between five and ten thousand dollars...his pro bono work was over, and if we won, the only reward would be the recouping of  lawyer's fees and court costs. I saw no reason to continue if there was no chance of making the bastards pay any real money.

So, a cashier's check for the settlement/reinstatement amount was sent by certified mail to Areola Humperdink and the horrors of the past year became history. That is, until the following week, when I received a certified letter from NBI informing me that I still owed for the August 2011 payment, and was now in default and subject to foreclosure immediately. Yeah, whatever. The August payment was sent (once again, certified mail to Areola Humperdink) sans late fee, and all was fine until the September payment was due.

It was mailed on time, but not by certified mail.. Surely, nothing could go wrong at this point. By the end of the month, however, the check had not been cashed. A call to Areola was placed. She informed me that the check had never been received. I didn't believe her, but put a stop payment on it and told her I would send a check for both September and October the following week but would not be adding any late charges. She was not happy, but agreed.
On the same day that we issued the new check, the bank informed us that NBI had tried to cash the check they told us they hadn't received. Luckily the stop payment was in place (at a cost of $28.00) or all checks would have been cashed and we would have been up shit creek without a paddle but lots of overdraft oars.

November payment was paid over the phone ($9.00 charge) on the 1st. On the 3rd, I received a bill for the late charges for September and October. I sent Areola a reply, telling her she could take the late charges out of the money she and NBI owe me. I reminded her that according to the terms listed in the signed settlement agreement, I'm due about $380.00 in late fees for the as of yet received payment coupon book and revised 1098 tax form. It's your move Ms. Humperdink.

And the beat goes on.

    What gripes me the most, I think, is that after all I went through, I'm still dealing with their incompetency. I truly don't see an end to this...even if payments are made BEFORE they are due.
